The Earned Sick Time Act Employees Have Earned the Right to be Sick

There are important employment laws that are scheduled to become effective in Michigan on February 21, 2025.  First, the minimum wage will increase to $12.48 per hour. 

Second, the Earned Sick Time Act will become effective. The paid sick leave requirement will generally apply to all employers and all employees who work in the state.

For every thirty hours worked, an employee is given one hour paid sick time. Employees of employers with 10 or more employees (for 20 or more calendar weeks in either the current or preceding year) will be entitled to use up to 72 hours of accrued paid sick leave per year. Employees of employers with fewer than 10 employees will also be entitled to use up to 72 hours of accrued sick leave per year, but only 40 hours of it must be paid (the other 32 hours may be unpaid).  All individuals working for compensation on a full-time, part-time or a temporary basis must be counted.

Employers must comply with many requirements under ESTA, including accrual and carryover, purposes for which accrued sick leave may be used, who are included as family members, employee notice of foreseeable use, employer posting requirements, record keeping, documentation, pay during leave, and effect of other leave policies.
